Welcome to AceGP! Please read these Terms and Conditions (“Terms”) carefully before using our website or services. By accessing or using our site, products, or services, you agree to be bound by these Terms (as well as our Privacy Policy). If you do not agree, please do not use our platform.

1. Definitions

Website refers to AceGP’s online platform, accessible at https://learn.acegp.com.au/.
Services include access to online exam preparation materials, courses, question banks, mock exams, and any other educational content provided by AceGP.
User (or “you”) refers to any person accessing or using our Website or Services. We, us, and our refer to AceGP (AceGP).

Our Services may rely on third-party platforms to deliver content. In such cases, AceGP is not responsible for any acts or omissions of those third parties, including any data breaches, downtime, or other failures.

2. Eligibility

To be eligible to use our Services, you must be a registered medical practitioner preparing for general practice or family medicine certification in Australia, Malaysia, Hong Kong, or another recognised jurisdiction. If you are practising in Australia, you must hold a current and valid registration number with the Australian Health Practitioner Regulation Agency (AHPRA). By using AceGP, you represent and warrant that you meet these eligibility requirements.

Organisations, educational institutions, examination bodies, or commercial competitors are strictly prohibited from registering for, enrolling in, or accessing any part of our Services without prior written approval from AceGP. Any unauthorised institutional access, whether direct or indirect, will be considered a material breach of these Terms and may result in immediate account suspension, termination, and legal action.

3. Account Registration

To access AceGP services, you are required to create an account. You agree to provide accurate and complete information when registering. Keep your account details and password secure. You are fully responsible for all activities under your account. Notify us immediately if you suspect any unauthorized use of your account or any security breach. We reserve the right to suspend or terminate accounts that violate our Terms.

Our collection and use of your personal information (including information you provide during registration) are governed by our Privacy Policy (see Section 14). We are committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By registering an account, you consent to our Privacy Policy and the handling of your data as described therein.

4. Intellectual Property

All content on the AceGP Website and Services—including questions, explanations, mock exams, text, graphics, logos, icons, and software—is the exclusive property of AceGP or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may use this content only for your personal, non-commercial study purposes.

You may not:

  • Copy, reproduce, upload, post, or distribute any part of the Services without our prior written consent.
  • Sell, license, or otherwise commercially exploit our content.
  • Create derivative works from our content.

5. User Conduct

By using our Services, you agree to:

  • Use the platform solely for personal, non-commercial educational purposes.
  • Comply with all applicable laws and these Terms.
  • Not disrupt, interfere with, or modify the Services (for example by hacking or using automated tools).
  • Not use the Services for any unlawful, abusive, or fraudulent purpose.
  • Not share your account credentials or allow any other person to use your account.

(Account sharing is strictly prohibited. Accounts found to be shared will be suspended or terminated immediately without refund.)

6. Payments and Refunds

All course fees must be paid in full at the time of enrolment. Payments are processed in Australian dollars (AUD) unless otherwise stated.

Refunds are provided under the following conditions:

  • Courses over 6 months: You may cancel your enrolment within 14 days of purchase for a 90% refund of the course fee.
  • Courses 6 months or less: Cancellations and refunds are not available after purchase, except as required by Australian Consumer Law.

Please review course details carefully before purchasing. Australian Consumer Law provides you with certain rights and consumer guarantees that cannot be excluded, even if they are not explicitly stated in these Terms.

7. Cancellations and Termination

You may cancel your enrolment by notifying us in accordance with the refund policy above. If eligible for a refund (per Section 6), we will process it after your cancellation request.

We may suspend or terminate your account and access to the Services (with immediate effect and without notice) if you breach these Terms. Reasons include, but are not limited to:

  • Account sharing or unauthorized access.
  • Misuse of the Services or violating any law.
  • Infringing any intellectual property rights.
  • Any fraudulent, abusive, or improper use of the platform.

If we terminate your account for breach of these Terms, you will not receive a refund for any Services.

8. Repeat Candidate Discount

AceGP offers a 20% discount to candidates who re-enrol in a second full course of six (6) months or longer after completing a previous AceGP course of at least that length. Proof of previous enrolment will be required. This discount is only for individual use and non-transferable. It cannot be combined with any other offers or promotions unless explicitly stated.

9. Disclaimers

Our Services are provided “as-is” and “as-available,” without warranties of any kind (to the fullest extent permitted by law). Specifically:

  • No guarantee of outcomes: We make no promise that using our Services will result in passing any particular exam or achieving any specific result. Exam success depends on many factors beyond our control.
  • Accuracy of content: We strive to keep materials current and accurate, but we do not guarantee they are error-free, up-to-date or complete. You should independently verify all information, especially for exam preparation.
  • Service interruptions: We do not guarantee uninterrupted or error-free service. Maintenance, technical issues, or third-party platform problems can cause downtime. AceGP is not liable for any data breaches, downtime, or other issues caused by third-party providers.
  • Warranties disclaimed: AceGP expressly disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In providing these disclaimers, we note that certain rights under the Australian Consumer Law cannot be excluded. Nothing in these disclaimers affects any non-excludable statutory rights you may have.

10. Limitation of Liability

To the fullest extent permitted by law, AceGP (and its affiliates, officers, employees, agents and licensors) will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other losses, arising out of or in connection with your use of the Services. This applies even if we have been advised of the possibility of such damages.

For example, we will not be liable for any failures of third-party services or networks. Our liability to you is limited to the maximum extent permitted by law. If liability cannot be excluded, AceGP’s liability is limited (at our option) to re-supplying the affected Services or the cost of re-supplying them. In no event will our total liability to you exceed the fees you have paid to AceGP for the relevant Services.

11. Changes to Terms

AceGP may update these Terms at any time. Any updated Terms will be posted on our Website and will take effect immediately upon posting. It is your responsibility to review the Terms periodically. Your continued use of the Services after any changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising from or related to these Terms or the Services will be subject to the exclusive jurisdiction of the courts of South Australia.
